Montreal-based Viagra Canada was looking at options to buy the drug from international wholesalers and drug wholesalers to sell the medication. The deal was announced Monday by the federal Drug Enforcement Agency (DEA) and the Montreal-based subsidiary of Pfizer Inc.
The agreement, which was made during a two-day trial of the drug, was expected to take several weeks to complete.
The announcement came after U. S. District Judge David R. Ehrlich of the U. District Court for the District of Quebec heard a class-action lawsuit filed by about 20,000 Pfizer customers in Quebec who had purchased the drug from international wholesalers and other drug wholesalers. The class-action suit against Pfizer of the drug sold in Canada is similar to that in New York, which was consolidated with the case.
Pfizer Canada, which makes Viagra, has not yet announced an estimated price of $1.16 billion for its products.
Pfizer Canada said its Canadian subsidiary would make approximately $500 million in revenue for Pfizer.
In the case, Pfizer said it would not have to pay any more than $500 million to the class-action plaintiffs to settle their claims. The claims were not directly related to the Pfizer-Canadian transaction.
In addition, Pfizer Canada said it will be filing an application to have its drugs distributed through Canada’s mail order pharmacy. That application was being submitted for approval by the U. Food and Drug Administration (FDA) and is expected to be filed by the end of the year.
Pfizer Canada said the claims would include the company’s ability to produce “bioequivalent” versions of the drug and will also have the option to sell the drugs in other countries to the benefit of the class-action plaintiff. The proposed Canadian drugs will be sold in Canada by Pfizer through its mail order pharmacy.
The suit was filed on behalf of the class of Canadian customers. It was filed in Quebec on Oct. 19.
The suit is the result of an investigation by the federal government’s Health Canada, the U. Department of Health and Human Services, and the Federal Court of Appeal.
The complaint has been filed by Pfizer Canada’s Canadian subsidiary and it was filed with the Supreme Court of Canada on Jan. 24.
“The Class Action Agreement provides Pfizer with the resources and capabilities to defend against the claims that it has made against it in connection with the distribution of the Class Action Agreement,” said U. District Judge R. Brent Saunders of the U. District Court for the Western District of Quebec, who was also the first federal judge to hear the class-action litigation in Quebec.
Pfizer Canada is seeking a $1.16 billion settlement from Canada for the class-action claims.
“The Class Action Agreement provides Pfizer with the resources and capabilities to defend against the claims that it has made in connection with the distribution of the Class Action Agreement,” Saunders said.
Pfizer Canada said it would “remain headquartered in Canada and is not aware of any Canadian or international rights, or any commercial rights, to manufacture, distribute, or sell any drugs.”
The agreement also was announced on Monday afternoon at a conference in Montreal, where Canadian lawyers will be presenting at the conference.
Pfizer Canada said it was working with other companies in the class-action litigation to secure a “non-binding” agreement from Pfizer Canada.
“This agreement is the first of its kind,” Pfizer Canada said. “We are in the process of evaluating the options and exploring all possible solutions.”
